Welcome to CricutNY (“CricutNY,” “we,” “our,” “us”). These Terms of Service (“Terms”) govern your access to and use of our website, membership, and digital assets (the “Service”). By creating an account, starting a free trial, or accessing any downloads, you agree to these Terms.

If you do not agree, please do not use the Service.

1) Who we are & how to contact us

Billing descriptor: Charges will appear as CRICUTNY (or similar) on your statement.

2) Subscription, free trial & auto-renewal

‌

When you click “Start Free” you agree to the following billing schedule (also shown at checkout):

Free 30 days → then $2 for the first paid month → then $7/month ongoing (until you cancel).

‌

• Auto-renewal: After the free trial ends, your membership automatically renews using your saved payment method.
• How to cancel: Cancellations must be done only through your user account page by clicking the one-click cancel button. We do not accept cancellations by email or through support tickets.
• 24-hour activation delay: After creating your account, it may take up to 24 hours before the cancellation button becomes active. This time is needed to fully activate your account and protect against fraud. During this period, you still have full access to download content.
• Timing: Cancel anytime after the activation delay. Cancellation stops the next renewal, but does not refund charges already processed.

3) Refunds, renewals & access

‌

• Digital access = no refunds. Membership gives instant access to thousands of digital downloads. All charges are final and non-refundable, including renewal charges, except where required by law.
• Cancel anytime: When you cancel, you keep access until the end of the currently paid period. No partial refunds.
• Billing issues: If you believe you were charged in error, contact us within 14 days at support-amanda@cricutny.com and we’ll review.

4) Resellers & premium tools (your side hustle rights 🚀)

As a premium CricutNY member, you have 100% commercial rights to use our special tools:

• 🌸 Flower Name Generator
• 🍫 Nutella Label Generator

‌

You may use these tools with no limitation to create and sell products on Etsy, Shopify, Amazon Handmade, or any other platform. You keep 100% of the profit.

‌

👉 You may sell the outputs (maps, name prints, labels), but you may not resell or share the underlying software/tools themselves.

‌

5) License to use our designs

When you’re an active member, CricutNY grants you a non-exclusive, non-transferable license to use our designs, fonts, and digital assets (“Assets”):

‌

• ✅ Personal use: unlimited personal projects.
• ✅ Commercial use: sell physical products (shirts, mugs, decals, etc.) or digital end products that significantly transform our Assets (not just resell the raw file).
• ✅ Resell-OK files: when marked as “Resell-OK,” you may redistribute them as-is under our stated rules.
• ❌ Prohibited: redistributing files that are not labeled Resell-OK, selling or sharing our source files, or using Assets in logos/trademarks without separate written rights.

6) Chargebacks & disputes

If you file a chargeback, we will submit evidence showing:

• That you accepted these Terms,
• Your IP/device info and timestamps,
• Download logs,
• Checkout confirmation with renewal schedule,
• Proof that cancellation was available through your account page.

We may suspend or terminate accounts for fraudulent disputes.

‌

7) Availability & changes

We may update, add, or remove content, features, or tools at any time. Access may be occasionally interrupted for maintenance.

8) Governing law

These Terms are governed by the laws of New York State, USA, without regard to conflict-of-law principles.

9) Entire agreement

These Terms constitute the entire agreement between you and CricutNY.

‌

10) Disclaimer on third-party brands (important)

All designs, fonts, and digital assets offered by CricutNY are original works crafted by hand by our design team. Some may be inspired by themes, styles, or characters that resemble well-known brands (e.g., “Barbie,” “Grinch,” etc.).

CricutNY makes no claim of affiliation, sponsorship, or endorsement by any third-party brand, and we do not license or sell trademark rights. By using our designs, you accept full responsibility for how you use them, including compliance with copyright, trademark, and marketplace rules.

‌

CricutNY is not liable for takedowns, IP disputes, financial losses, or legal claims arising from your use of designs that reference or resemble third-party brands. If you are unsure whether your intended use is lawful, it is your responsibility to seek legal advice.
